Terms and Conditions

Lessee and Driver(s)

1.  The Primary Lessee named on this agreement must be at least 25 years of age to rent a boat and must present a valid G driver’s license (not learners permit) and boater’s license in person at the time of rental. All other drivers (aside from the primary lessee) must also meet the age and licensing requirements mentioned above. Additional drivers must also present their driver’s license in person, and be present for driving instruction to be eligible to drive our rental boats.

2.    Primary Lessee and/or Drivers must obey by the rules and regulations of the Canadian Coast Guard. Drugs or alcohol are strictly prohibited on the watercraft. The Forest Hill Lodge reserves the right to refuse rental to anyone that is suspected of being under the influence of drugs or alcohol.

3.    The Forest Hill Lodge provides all of the safety equipment required for each vessel as indicated under the Marine Safety by Transportation Canada to ensure the boat or personal watercraft is legal.


Booking Deposits & Cancellations

1.    A Non-Refundable Booking Deposit of $100 is required for all fishing boat reservations at the time of booking.

2.    The Forest Hill Lodge requires a minimum of 7 days’ notice for cancellation of a rental.

3.    Our rental day starts at time of check in, or for a daily rate at 9:00 a.m.  If a booking is cancelled with more than a 7 days’ notice, the deposit will be returned to the Primary Lessee.

4.    If The Forest Hill Lodge is not notified 7 days before 9:00 a.m. on the first day of the rental or if no notice is given at all, the Primary Lessee will not be refunded their booking deposit.

5.    In the case of unsafe weather conditions, as determined by The Forest Hill Lodge staff (such as sustained high winds or lightening), The Forest Hill Lodge reserves the right to refuse the rental because we feel it is unsafe to be out on the water. The rental may be rescheduled for another date and the non-refundable booking deposit applied to that new booking.


Damage Deposit and Responsibility

1.    A $1,000 damage deposit is taken on the Primary Lessee credit card as a pre-authorization payment at the time of the rental.  This is a requirement of all rentals. 

2.    The Primary Lessee is responsible for any damage that occurs to the boat, equipment and all provided contents. All vessels will be checked and photographed for damages before and after the rental with you present. Charges will be administered when a final damage quote is known.


Late Return Charges

1.    A Late Charge of $1/minute will apply if boat or equipment is returned after the designated return time.


Boat Use

1.    Must comply with passenger capacity listed on each boat.

2.    The boat is not to be taken out of the water and transported at any time.


Fuel & Other Charges

1.    All rental boats come with a full tank of gas.

2.    Lock fees are not included in the rental fee. If you choose to go through any locks , you will be responsible to pay the Trent Severn Waterway directly for the locking fee.  For lock hours and pricing please refer to the Trent Severn Waterway website at https://www.pc.gc.ca/en/lhn-nhs/on/trentsevern/visit/


Release of Liability

1.    The Lessee agrees to indemnify, defend, and hold harmless the Owner, its officers, agents, employees, and affiliates from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with the Lessee’s use, operation, or possession of the rented boat. This includes, but is not limited to, claims for personal injury, property damage, and wrongful death.

2.    The Lessee understands and acknowledges the inherent risks involved in boating activities, including but not limited to risks of injury, drowning, or other harm. The Lessee voluntarily assumes all risks associated with the use of the rented boat and agrees that the Owner shall not be held liable for any injury or damage resulting from any cause, whether foreseeable or unforeseeable.

3.    This Hold Harmless Clause shall survive the termination or expiration of this boat rental agreement.

4.    The Renter agrees to be fully responsible for any and all damages to the rented boat occurring during the rental period. This includes, but is not limited to, damage to the hull, engine, equipment, and any other parts of the boat. The Renter agrees to promptly report any damage to the Owner and to reimburse the Owner for any repair or replacement costs incurred as a result of such damage.

 

Governing Law

This agreement shall be governed under the laws of Ontario.  Any claims arising from this agreement must be filed in Ontario.

$175+tax/day

$595+tax/week


Acknowledgement

I acknowledge and confirm that I am aged 25 years or older, that I have read, understood and agree to all the Terms and Conditions of renting a fishing boat as outlined in this agreement and that all of the information I have provided is truthful and correct.
