Terms and Conditions
1. GENERAL CONDITIONS OF RENTAL
1.1 Renters shall abide by this agreement and all instructions and information provided by The Forest Hill Lodge. All conditions, provisions and instructions apply to all guests/visitors to the premises being offered for venue rental.
1.2 The Cottage Welcome Page containing information and contact numbers are an extension of the Terms and Conditions of renting and renters shall, by entering into this contract, agree to abide by the rules contained therein.
1.3 Failure to comply with any of the Terms and Conditions of Renting shall result in immediate eviction without refund and/or a penalty of $150.00 per day administration fee, at the discretion of the Owners.
1.4 The Renter agrees to allow the Owners to check all references supplied by the Renter, if requested.
1.5 Upon acceptance, this agreement shall become a binding contract between the Owners and the Renter.
1.6 The Renter agrees that the cottage is to be used solely for recreational purposes and no illegal nor commercial activities shall be carried on.
1.8 The Renter(s) shall supply any consumable items they may need. Firewood will be available for purchase on site. Please do not bring your own firewood as this may spread harmful pests.
1.9 Basic needs such as toilet paper, hand soap and dish soap will be available.
2. RENTAL FEES
2.1 Rental fees and payment information shall apply as provided by the Owner.
2.2 Receipt of deposit will constitute acceptance of booking.
2.3 If payments are not received as outlined the booking will be treated as a cancellation and the procedures set out in Section 3 of this contract shall apply.
3. CANCELLATION
3.1 Any cancellation by the Renter shall be made in writing (by email or text). Notice of cancellation received 60 days prior to the event date will receive full refund of monies paid. For notice on or after 60 days of the event date:
3.1.1 On receipt of a cancellation notice, the Owners will vigorously endeavour to re-book the venue for the entire period of the original booking.
3.1.2 If the Owners succeed in re-booking the venue for the entire period of the original booking, the owners will refund to the Renter all monies paid (whether by deposit or otherwise) less an administrative fee of $75.00. If the Owners are only able to re-book the cottage for a portion of the period originally booked, the Owners will refund the monies paid relating to the period re-booked less a $75.00 administrative fee.
3.1.3 If the Owners are unable to re-book the venue at all, then the Renter shall forfeit all monies paid.
3.2 If the property is damaged, destroyed, uninhabitable, or is unavailable for any other reason, then the Owners may terminate this agreement by giving written notice to the Renter. All payments for unused days that the Renter has made will be refunded and the Owners will not have any further liability to the Renter.
4. SECURITY DEPOSITS AND DISPUTES
4.1 The Renter must notify the Owners or the Owner's Alternate Contact immediately if there is reasonable cause for complaint. Failure to do so may result in the complaint not being investigated and remedied.
4.2 In the event of any disputes between the Renter and the Owners of the cottage concerning matters of property damage, failure to clean, etc., every effort will be made to negotiate a mutually agreeable resolution. In the event of deadlock, the Owners retain the right to make the final assessment of any charges accrued as a result of the issue.
4.3 The Renter is responsible for damage to the venue (inside and outside), including recreational equipment, and the Renter's liability shall be equal to the actual cost of repairing any damages, however caused by himself/herself or any other occupants, guests, visitors or family members at the cottage.
4.4 Every effort has been made by the Owners to provide the facilities and features to make the event of the Renters an enjoyable experience. The Owners have attempted to establish a rental fee in accordance with similar and even lesser properties. However, we cannot forecast the expectations of every individual. We believe our offering is reasonable value for your rental fee.
5. CHANGES TO INVENTORY LISTING AND/OR PRINTED MATERIAL
5.1 The Owners have endeavoured to ensure that all information relating to the resort and venue is current and accurate. However, changes may be unavoidable as a result of the activities of other families. Additionally, the Owners are constantly striving to upgrade the features.
5.2 Items considered fundamental to the rental shall include plumbing and electrical systems. The Owners cannot accept responsibility for lack of use of these items due to power outages and/or weather conditions.
5.3 The lack of availability of non-fundamental items (i.e., kayaks, TV, DVD player, other recreational equipment, and items listed under the "features section" of a listing) shall not result in a refund to the Renter. The Owners will make every attempt to ensure that these items/equipment are available and in good working order during the rental. However, these items/equipment are provided at the discretion of the Owner as an added feature for use by the Renter. The Owner will not be obligated to refund the Renter for the lack of use of these items.
5.4 The Renter is aware that water levels may fluctuate, and swimming conditions may change due to weather, time of year and seasonal conditions. The Owner takes no responsibility for refunds to the Renter for such natural changes.
6. PERSONS USING THE ACCOMMODATION
6.1 Renter(s) are not permitted to sublet the venue.
6.2 The Renter must be staying at the venue during the entire period of booking, otherwise a separate Cottage Rental Agreement must be completed and approved by the Owners for each Rental party.
6.3 Camping, tenting or the placing of additional lodging facilities on the premises is forbidden unless authorized by the Owners in writing.
6.4 "Venue occupants" means renter(s), overnight guests, and day visitors to the cottage. .
6.5 The number of persons present overnight (including guests) must never exceed the number indicated by the renter on the front of this form in the Venue Occupants section. The number of persons present during the day (including guests) must not exceed the number indicated by the renter in the Number of Guests section above on this form, without prior written permission by the Owners. Only those people listed by the renter on this form (whether renters, overnight guests or day visitors) are authorized to be at the venue during the rental period.
6.6 Failure to comply with Section 6.5 shall result in reduction in the refundable portion of the security deposit.
7. OTHER CONDITIONS
7.1 The Owner shall be allowed access to the venue at any time during the rental period for inspection or maintenance.
7.2 The Renter agrees that he/she will not remove any fixtures, goods or chattels from the property.
7.3 Should unreasonable noise or rowdiness occur during any time of the rental period, the Renter and all members of his/her party shall be liable to immediate eviction without refund and/or be subject to an administrative fee of $75.00.
7.4 The Renter agrees to lock all doors when leaving the venue and upon completion of the rental period. Failure to comply with the above mentioned will result in a $50.00 administrative charge being levied.
7.5 If a boat or any type of watercraft is provided, it is the responsibility of the renter for ensuring that all rules, laws, regulations and safe boating practices that apply to the boat and/or watercraft, its operators and passengers, and the waters in which it operates, are adhered to and followed. The Renter is responsible for familiarizing him/herself and the venue occupants with the navigational hazards of the lake or water body. The watercraft are to be used in the vicinity of the Forest Hill Lodge and shall not be taken off of Lovesick Lake.
7.6 The venue is being rented “as is” with no guarantees of its suitability for all age groups. Parents with children or Renters inviting guests who are differently abled assume the risks of ensuring their safety when using the property. Please inform the Owners of any issues that can be remedied to make the Renters’ stay more enjoyable.
7.7 Absolutely no smoking or vaping shall occur within the cottages, the Lodge or in screened in rooms. Cigarette butts can be disposed of in the fire pit, for safety.
I wish to rent the property specified above. I acknowledge and confirm that I am aged 18 years or older, that I have read, understood and agree to all the Terms and Conditions of renting as outlined here and that all the information I have provided is truthful and correct. I acknowledge that I am responsible for any damage to the premises, inside or outside, caused by me or any guests. I agree to indemnify and hold harmless Mat and Jacqueline Bedard, the owners, and Bedard MJS Holdings Inc. (o/a The Forest Hill Lodge) from any claims whatsoever resulting from my booking, including claims of personal injury, loss, damage or theft, however caused to myself or any other cottage occupant who may be on the premises or using any recreational equipment that is brought to or available at the cottage. I shall assume all risks of any such injury or loss. I will also read, abide by and be responsible for all rules and provisions of The Forest Hill Lodge and that I will leave the property in a clean and tidy condition.
